1. In the daytime, plaintiff alighted from his car, parked on the right-hand side of a city street at an intersection. Intending to cross to the other side he passed in front of his own car and into the lane of southbound traffic without looking to the north to see whether cars were approaching from that direction. His vision to the north was unobstructed for over two blocks. He was run into by defendants car, which he did not see until the moment of impact. Held that plaintiff was guilty of contributory negligence as matter of law notwithstanding that he did glance to the north through the rear window of his own automobile before alighting therefrom.
