THIS case was brought up, by writ of error, from the Supreme Court of the state of Arkansas. On the 2d of November, 1836, the state of Arkansas passed an act to incorporate the Bank of the State of Arkansas. The capital was one million of dollars, which was raised by a sale of the bonds of the state, or by loans founded upon those bonds. The president and directors were appointed by a joint vote of the General Assembly. All dividends upon the capital stock were declared to belong to the state, subject to the control and disposal of the legislature.
